These Terms & Conditions ("Terms") govern your use of the online learning platform operated by Damnjan Jovanovic ("Damnjan", "we", "us" or "our") and your purchase and use of our online courses, video lessons, digital learning materials and live online sessions.
By creating an account, accessing the platform or purchasing a product or service, you agree to these Terms.
1. Provider

2. About the Platform
Our platform provides educational content and online learning services, including:
- pre-recorded video lessons;
- educational materials and resources;
- free previews of selected content; and
- live online sessions.
The exact content and scope of each product are described on the relevant product page before purchase.
3. The Annual Membership
The main product currently offered through the platform is an annual learning package priced at 249€.
The annual package provides access for a period of 12 months and includes:
- access to the included pre-recorded video lessons;
- access to the included digital learning materials; and
- participation in generally one 1-hour live online session per month.
The specific content included in the package may be described in more detail on the relevant product page.
Unless expressly stated otherwise, the annual package does not automatically renew. Access ends when the 12-month access period expires.
4. Free Registration and Preview Content
You may be able to create an account and access certain free content without purchasing a paid product.
Free preview videos and other free materials are provided for demonstration purposes so that you can evaluate the educational content before making a purchase.
Access to free preview content does not give you access to the complete paid course.
We may change, update or discontinue free preview content at any time.
5. User Account
Some features of the platform require you to create a user account.
You agree to provide accurate and complete information when registering and to keep your login details secure.
Your account is personal to you. You must not share your username, password or other access credentials with another person.
You are responsible for keeping your account credentials confidential and for activity carried out through your account, unless you can demonstrate that the activity occurred without your fault.
We may temporarily suspend an account where we have reasonable grounds to believe that the account is being used in breach of these Terms, particularly where paid access is being shared with other people.
6. Purchase and Contract Formation
The presentation of products on the website does not necessarily constitute a legally binding offer.
When you place an order, you are making a binding offer to purchase the selected product or service.
Before submitting your order, you will be given the opportunity to review and correct the information you have entered.
The contract is concluded when we accept your order, for example by sending an order confirmation or by providing access to the purchased product, unless a different procedure is expressly stated during checkout.
After the purchase, you will receive confirmation of the transaction electronically.
7. Price and Payment
The current price of the annual package is 249€.
Where applicable, prices include statutory German VAT.
Available payment methods may include:
- Payment by credit card or other payment methods processed through Stripe
- Payment by invoice.
The payment methods available to you will be displayed during checkout.
If you choose payment by invoice, the invoice will specify the applicable payment deadline. You agree to pay the invoice within that period.
8. Access to Digital Content
Following successful purchase and, where applicable, successful payment, we will provide you with access to the purchased digital content through your user account.
Access is intended for your personal use during the agreed 12-month access period.
You are responsible for having a suitable device, internet connection and any software reasonably required to access the platform.
9. Personal and Non-Transferable Access
Your purchase provides you with a personal, non-exclusive and non-transferable right to access and use the purchased content for your own educational purposes.
You may not transfer, sell, sublicense or otherwise provide your account or paid access to another person.
If you are purchasing access on behalf of a business or organisation, access is provided to the individual user or users expressly covered by the relevant purchase or agreement.
If a business requires access for multiple employees or users, the applicable number of users should be agreed with us before purchase.
10. Use of Video Lessons and Course Materials
All paid video lessons and course materials are provided for your personal educational use.
You may watch and use the materials during your access period, but you may not:
- share your account or login credentials with other people;
- copy or reproduce the videos or course materials except where permitted by law;
- download, record or capture the content for the purpose of redistributing it;
- upload the videos or materials to another website, platform or file-sharing service;
- publicly display, broadcast or distribute the content;
- sell, sublicense or otherwise commercially distribute the content;
- use the materials to create or operate a competing course or training product; or
- circumvent technical measures designed to protect the content or restrict access.
Nothing in these Terms restricts rights that you cannot legally waive under applicable law.
11. Intellectual Property
All videos, presentations, text, graphics, exercises, documents, audio recordings, illustrations, course structures and other materials made available through the platform are owned by or licensed to Damnjan Jovanovic and are protected by applicable intellectual property laws.
Purchasing access to a course does not transfer ownership of any intellectual property to you.
You receive only the limited right to access and use the purchased content in accordance with these Terms and for the duration of your access period.
12. Live Online Sessions
The annual package includes generally one 1-hour live online session per month during the 12-month access period.
Information about upcoming sessions, including dates, times and access instructions, will be communicated through the platform, by email or by another appropriate method.
Live sessions are subject to reasonable scheduling requirements. We may occasionally change or reschedule a session due to illness, technical problems, unforeseen circumstances or other legitimate reasons.
If we cancel a scheduled session, we will make reasonable efforts to provide an alternative date or another appropriate solution.
Unless otherwise agreed, unused monthly live sessions cannot be accumulated and carried over to future months.
Participation in live sessions requires you to have a suitable device, internet connection and any software reasonably required to participate.
13. Recording of Live Sessions
Live sessions will not be recorded
14. Educational Nature of the Content
The courses, videos and live sessions are educational in nature.
They are intended to provide knowledge, techniques, ideas and educational guidance.
Unless expressly stated otherwise, we do not guarantee any particular professional, financial, business or personal result from using the platform or completing a course.
Your results depend on a variety of factors, including your individual circumstances, prior knowledge, effort and application of the information provided.
15. Statutory Right of Withdrawal for Consumers
If you are a consumer within the meaning of applicable law, you may have a statutory right of withdrawal from contracts concluded online.
The details of this statutory right, including the applicable withdrawal period and the conditions under which it may expire for digital content, are provided separately in our Withdrawal Policy / Withdrawal Information.
For digital content that is not supplied on a physical data carrier, applicable German law provides for circumstances in which the statutory withdrawal right may expire once performance begins, provided the legally required conditions are met. These conditions can include the consumer's express consent to the commencement of performance before the expiry of the withdrawal period and acknowledgement that the withdrawal right will be lost as a result.
Nothing in these Terms limits or excludes any mandatory statutory consumer rights.
16. Voluntary 14-Day Money-Back Guarantee
In addition to any statutory rights you may have, we offer a voluntary 14-day money-back guarantee for the annual package, subject to the conditions below.
You may request a refund within 14 days of your purchase provided that you have:
- not started or watched any paid video lesson; and
- not otherwise used the paid course content.
Viewing free preview videos does not affect your eligibility for this voluntary money-back guarantee.
To request a refund under this voluntary guarantee, please contact us at hello@damnjan.de within the applicable 14-day period.
This voluntary money-back guarantee is separate from and does not replace, restrict or limit any statutory consumer rights, including any applicable statutory right of withdrawal.
17. Technical Requirements and Availability
We aim to keep the platform available and functioning reliably, but we cannot guarantee uninterrupted or error-free availability at all times.
Temporary interruptions may occur due to maintenance, technical failures, hosting or third-party service interruptions, internet problems, security incidents, force majeure or other circumstances beyond our reasonable control.
Where required by applicable law, statutory rights relating to the functionality, conformity and availability of digital content remain unaffected.
18. Changes and Updates to the Content
We may update, improve, modify or expand the educational content and platform from time to time.
We will take reasonable account of the legitimate interests of customers when making changes.
Where mandatory statutory rules apply to changes to digital content or digital services, those rules will take precedence over these Terms.
19. Prohibited Conduct
You must use the platform lawfully and in accordance with these Terms.
You must not:
- attempt to gain unauthorised access to another user's account;
- attempt to circumvent security or access controls;
- interfere with the technical operation of the platform;
- intentionally introduce malicious software or other harmful code;
- scrape or systematically copy substantial amounts of platform content; or
- use the platform for any unlawful purpose.
20. Suspension or Termination of Access
We may suspend or terminate access where this is permitted by applicable law and where there has been a serious or repeated violation of these Terms.
This may include serious cases of account sharing, unauthorised distribution of paid content, fraud or attempts to compromise the security of the platform.
Where required by law, we will consider the circumstances of the individual case and any applicable statutory rights before taking such action.
21. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
We are liable without limitation for damage arising from injury to life, body or health caused by an intentional or negligent breach of duty, as well as for other damage caused intentionally or through gross negligence.
In cases of slight negligence, our liability is limited to breaches of essential contractual obligations and to damage that is foreseeable and typical for the contract, to the extent permitted by law.
Mandatory statutory liability remains unaffected.
22. Consumers and Businesses
These Terms apply to both consumers and business customers.
Where a provision of these Terms applies only to consumers or only to business customers, this will be stated expressly.
Mandatory consumer protection provisions apply to consumers regardless of any contrary provision in these Terms.
If you purchase the service on behalf of a company or other organisation and are acting in the course of your commercial or professional activity, you confirm that you are authorised to enter into the agreement on behalf of that organisation.
23. Business Customers
If you are purchasing the service as a business customer, the statutory consumer right of withdrawal does not apply to you unless otherwise required by mandatory law.
Where permitted by applicable law, different statutory rules may apply to business customers regarding liability, warranties, jurisdiction and other contractual matters.
Nothing in this section excludes mandatory statutory rights.
24. Privacy
Information about how we collect, use and protect personal data in connection with the platform, user accounts, payments, live sessions and other services is provided in our Privacy Policy.
25. Payment Providers
Where payment is processed through Stripe, payment processing may be carried out by Stripe or its relevant affiliated entities and is subject to the applicable Stripe terms and privacy information.
We may also offer payment by invoice.
We reserve the right to add, remove or change available payment methods, subject to applicable law and the terms applicable to an order that has already been accepted.
26. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protection provisions applicable in the country where a consumer has their habitual residence.
If you are a consumer, this choice of law does not deprive you of the protection provided by mandatory provisions of the law that would otherwise apply to you.
27. Jurisdiction
If you are a consumer, the applicable statutory rules concerning jurisdiction apply.
If you are a business customer, a legal entity under public law or a special fund under public law, and to the extent legally permissible, the courts at the registered business address of the provider shall have jurisdiction over disputes arising from the contractual relationship.
28. Changes to These Terms
We may update these Terms from time to time where there is a legitimate reason to do so, including changes in law, changes to the platform or changes to our services.
The version applicable at the time of your purchase will generally govern that purchase, subject to any mandatory statutory requirements.
29. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Any mandatory statutory provision will apply in place of an invalid or unenforceable provision.
